Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023/Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the Petitioner for quashing of FIR No. 0280/2022 registered under Sections 420/24 IPC at P.S. Fatehpuri Beri and the proceedings emanating therefrom in terms of the Settlement Affidavit dated 24.10.2024. 2.

As per the FIR, during the Covid time, apparently the Petitioner was approached by the husband of her colleague for applying for this Covid insurance. She also got her medical test done and submitted her Covid positive report to Respondent No. 2 who in turn gave the protection insurance money of Rs.50,000/-. However, on subsequent verification, the medical report of the Petitioner was found to be forged. Consequently, the FIR was registered under Sections 420/24 IPC. The Petitioner who is present in person submits that in face, she was defrauded by husband of her colleague, who was little known to her. The money i.e. Rs.50,000/- has been returned to the Insurance Company. 4.

AR of Insurance Company is appearing through VC, who endorsed the amicable settlement and accepted the terms thereof voluntarily and submit that the said Settlement has been arrived at between the parties, without any pressure and coercion and that they shall remain bound by the terms of the settlement.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Accordingly, in view of the submissions made and Settlement Affidavit dated 24.10.2024, the FIR No. 0280/2022 registered under Sections 420/24 IPC at P.S. Fatehpur Beri and all the consequential proceedings emanating therefrom are quashed.
