By way of the present petition, the petitioner is seeking quashing of FIR bearing no. 281/2022, registered at Police Station Fatehpur Beri, for the commission of offences punishable under Section 420/24 of Indian Penal Code, 1860 (hereafter 'IPC') and all consequential proceedings arising therefrom.

Brief facts of the case are that on 04.01.2021, the petitioner herein had filed a claim under the covid-19 insurance policy from the respondent no. 2's company. Thereafter, after some time the claim of the petitioner was declared false by the respondent no. 2 and upon the complaint by respondent no. 2, the present FIR came to be registered against the petitioners. It is stated that during the pendency of the case, the parties who are present before this Court, have now amicably settled their dispute vide Settlement Agreement dated 24.10.2024 and the petitioner herein has returned the amount of Rs. 50,000/- to the respondent no. 2/AR . 7.

On a query made by this Court, respondent no. 2 who is the authorized representative of the company and has been identified by the IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat.. Therefore, he has no objection if the FIR is quashed.

In view of the above, that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing no. 281/2022, registered at Police Station Fatehpur Beri, for the commission of offences punishable under Section 420/24 of IPC and all consequential proceedings emanating therefrom are quashed.

Accordingly, the present petition along with pending application, if any, stands disposed of.
