SANJEEV SACHDEVA, J. (ORAL) 1.
Petitioner seeks regular bail in FIR No. 433/2018, under Section U/S 324/354/506/34 IPC P.S. Paschim Vihar. 2.
Allegations of the prosecutrix is that she resides in a jhuggi along with her child and on the date of the incident the co accused Pappu Saansi along with three other boys came on the spot and started teasing and abusing her. It is alleged that the co accused slapped her and when her daughter intervened, he assaulted her with a sharp instrument.

Learned counsel for the petitioner submits that petitioner has been falsely implicated. He submits that there are no allegations against the petitioner of either slapping or assaulting either the complainant or her daughter. Learned counsel further submits that the petitioner was not even on the spot. He submits that petitioner has been in custody since 15.12.2018.

Without commenting on the merits of the case and keeping in view the totality of the facts and circumstances of the case, I am satisfied that the petitioner has made out a case for grant of regular bail.

Accordingly, on petitioner furnishing a bail bond in the sum of Rs. 10,000/- with one surety of the like amount to the satisfaction of the Trial Court, petitioner shall be released on bail, if not required in any other case. Petitioner shall not do anything which may prejudice either the trial or the prosecution witnesses. 6.
Petition is allowed in the above terms.
