+ W.P.(CRL) 141/2017 SUNIL NAYAK @ FUNDI ..... Petitioner Through :

Mr. Hemdndra Jailiya, Adv.

versus STATE (NCT OF DELHI) ..... Respondent Through :

Mr. Sanjay Lao, ASC with SI Sachin Yadav PS Sarai Rohilla.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 20.01.2017 Petitioner seeks parole on the ground that he is suffering from severe jaundice and has not been provided treatment inside the jail. Learned Additional Standing Counsel has placed on record the report of Medical Superintendent, Jail Dispensary.

A perusal of report makes it clear that petitioner is being provided proper medical treatment in jail dispensary as well as in other hospitals. Presently, he is in Lok Nayak Hospital. Petitioner's past conduct is not good as is evident from a perusal of the order dated 7th December, 2016, passed by a Bench of Co-ordinate Jurisdiction in W.P. (Crl.) No.3137/2016.

Petitioner was released on parole in the year 2010. He jumped the parole and was re-arrested only after three years, that

is, on 27th June, 2013.

Accordingly, I do not find it to be a fit case to release the petitioner on parole.

Dismissed.

A.K. PATHAK, J.
