% 03.05.2016 C.M. Appl. No.14611/2016 This is an application under Order XXIII Rule 1 Sub-rule (3) of CPC filed on behalf of petitioner seeking permission to withdraw the present petition.

For the reasons mentioned in the application, the application is allowed and the petitioner is permitted to withdraw the petition. The application stands disposed of.

W.P. (C) No.1020/2016 The petitioner has filed the present petition under Article 226 of the Constitution of India, inter alia, seeking quashing of order dated 15.12.2014 passed by BSES Rajdhani Power Ltd. whereby penalty imposed vide order dated 02.09.1997 was confirmed.

Learned counsel for the petitioner submits that the petitioner had filed an appeal before the CEO, BSES and the same has been dismissed vide order dated 29.02.2016.

In view of the application bearing C.M. No.14611/2016, Mr. Anuj Aggarwal, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to challenge the order dated 29.02.2016.
