+ CRL.M.C. 1402/2019 and Crl. M.A. no. 5564/2019 SUMIT KUMAR & ORS.

..... Petitioners Through Mr. Ajay Kumar, Adv.

versus STATE OF NCT & ORS ..... Respondents Through Mr. Amit Chadha, APP Respondent nos. 2 to 4 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 14.03.2019 Notice.

Learned APP accepts notice for respondent no. 1.

Respondent nos.2 to 4, namely, Mr. Ved Parkash @ Ramesh , Mr. Mahesh Chand and Mr. Kamal Deep are present in Court and accept notice. They have been identified by SI Naeem Ali of police station Bhajan Pura. Respondent nos.2 to 4 submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion and have no objection in case FIR No. 679/2017 under Sections 323/341/308/34 IPC registered at Police Station Bhajan Pura and consequent proceedings emanating therefrom are quashed.

Affidavits of respondent nos. 2 to 4 to this effect are also on record.

Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 to 4 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.

A.K. PATHAK, J.
