By the present petition, the Petitioner essentially seeks issuance of a writ in the nature of mandamus thereby directing the Respondents to grant pension and all other consequential benefits to the Petitioner on account of her having served the Respondents for more than a decade.

Pertinently, the Petitioner was working as Head Constable, and had applied for discharge/resignation in the year 1997. The Petitioner's resignation was accepted and she was discharged in August, 1997. The Petitioner thereafter in the years 2012, 2017 and 2022 made representations to the Respondents and prayed for grant of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. pensionary benefits which was rejected by the Respondents on 18.08.2023. Aggrieved by the same, the present petition has been preferred.

The learned counsel representing the Respondents submits that the Petitioner is not entitled to pensionary benefits as she had resigned from the services.

It is not disputed that resignation from service results in forfeiture of past services thereby making the employee ineligible to claim pensionary benefits.

Keeping in view the aforesaid position, no ground to issue writ has been made out.
