The present petition under Article 226 of the Constitution of India has been filed by the Petitioner - Anil Kumar Gupta, seeking direction to the Respondents to permit him to participate in the Survey of Street Vendors which is currently being undertaken by the Town Vending Committee ('TVC').

In this petition, it is stated that the Petitioner has been continuously vending at Opp. Shop No. 20, Regal Building, Connaught Place, New Delhi The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

for the last several years since 1990. It is also stated that he has various challans to prove the fact that he has been vending prior to the Street Vendor (Protection of Livelihood of Street Vending) Act, 2014. He has alleged to have been removed from the vending site in the year 2021 by the Respondents due to the site being a 'No-Vending Zone' as per the Scheme prepared by Respondent No.2 in 2007.

Reliance is placed upon the order passed by this Court in W.P.(C) No. 2417/2025 titled Gauri Shankar v. New Delhi Municipal Council & Anr. and 2418/2025 titled Anil Kumar Gupta v. New Delhi Municipal Council & Anr. wherein the petitioners were permitted to participate in the survey currently being undertaken by the concerned TVC. 6.

Ld. Counsel for the Respondents objects on the ground that the Petitioner has already preferred the above mentioned writ petition being W.P.(C) 2418/2025 titled Anil Kumar Gupta v. New Delhi Municipal Council & Anr.

In response, ld. Counsel for the Petitioner submits that the said petition relates to another person of the same name who was vending at a different site being Palika Bazar, Connaught Place. The present case is different and the Petitioner is also different. 8.

In view of the above circumstances, subject to it being verified that the present Petitioner is different person than the one who preferred W.P.(C) 2418/2025 by the New Delhi Municipal Council ('NDMC'), the Petitioner is permitted to furnish documents and to participate in the survey being undertaken by the TVC.
