O R D E R

% 13.10.2015 Learned counsel for the plaintiff submits that plaintiff has stopped instructing the counsel. It is further contended that plaintiff has not even led any evidence and plaintiff's evidence has been closed on 31st August, 2015. It is submitted that several emails have been sent to the plaintiff since July, 2015 categorically informing the plaintiff that in case instructions are not received, counsel will withdraw from the brief. It is further submitted that date of hearing has also been informed to the plaintiff but no instructions have been received.

Photocopies of emails have been placed on record.

Counsel for the plaintiff is discharged from the brief. Since no one appears for the plaintiff, suit is dismissed in default. Miscellaneous application is disposed of as infructuous.
