The present proceedings are instituted seeking quashing of complaint case No.55732/2007 (New No.49586/16), filed under Sections 451/380 IPC, pending in the Court of CMM (East), Karkardooma Courts, Delhi and its consequential proceedings.

The present complaint was filed against the petitioner who had jointly taken an office premises on rent along with respondent No. 2. The disputes between the parties arose when the petitioner purchased the said premises and some of the articles of respondent No. 2 were found missing. 3.

Learned counsels for the parties submit that the parties have amicably settled their dispute before the Mediation Centre, Karkardooma Courts, Delhi on 19.03.2019 and in terms of the said settlement, respondent No.2 is now left with no claim or grievance against the petitioner.

The petitioner and respondent No.2, who are present in person, are identified by their respective counsels and the Investigating Officer. 5.

Respondent No. 2, who is present in Court, states that he has entered into the settlement with the petitioner out of his own free will, volition and without any coercion. He further states that he has no objection if the aforesaid complaint case and all proceedings emanating therefrom are quashed.

Learned counsels for the parties submit that no other proceedings are pending between the parties.

The parties are bound by the statements made in Court today. 8.

In view of the aforesaid amicable settlement arrived at between the parties, no useful purpose will be served in continuance of the proceedings in the complaint case, it is hereby directed that the aforesaid complaint case and the consequent proceedings arising therefrom are hereby quashed, subject to cost of Rs.5,000/- to be deposited by the petitioner with the "Delhi High Court Legal Services Committee" within a period of one week. Proof of deposit be filed in Court as well as with the Investigating Officer. 9.

The petition stands disposed of along with the pending application. 10.
