This petition has been filed under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) wherein the petitioners are seeking directions to be issued to the respondent nos. 1 to 4 to provide police protection to the petitioners.

The facts reveal that the petitioners and respondent no.5 are cousins involved in a family dispute. The petitioners have been receiving threats from the respondent no.5 and his family for withdrawing all pending complaints filed against the respondent no.5. 3.

Learned counsel for the petitioners submits that police protection should be granted to the petitioners in lieu of the fundamental rights enshrined under Part III of The Constitution of India. that the respondent no.5 and his family members have been repeatedly threatening the petitioners, asking them to withdraw all the pending complaints filed against the respondent no.5. 4.

Learned ASC appearing for the State submits that the present dispute inter se the petitioners and respondent no.5 is qua a family dispute. He submits that the police shall be providing protection and any assistance as and when sought for.

This Court is of the opinion that every individual has an inherent right of life and liberty as enshrined under Part III of The Constitution of India. Thus, the petitioners are well and truly entitled for protection under Article 21 of the Constitution of India.

Accordingly, the petition is allowed and the Station House Officer, Inspector K.L. Yadav (+91 7065036027) and Head Constable Sandeep Punia (Beat Officer) (+91 9868775948), P.S: Shahdara, Delhi are directed to provide protection to the petitioners and their family members, as and when and if, the need arises, in accordance with law. 7.
