This writ petition seeks the following reliefs: "(a) Issue an appropriate writ, order or direction in the nature of mandamus thereby directing the respondent no. 1 & 2 to take necessary action against to release the dearness allowance to which the petitioner is entitled. (b) Issue a writ of mandamus or any other appropriate writ/order directing the Respondents to coordinate with each other and clarify the issue of dearness allowance and forthwith release Dearness Allowance on pension to the Petitioner from 15.06.2007 onwards, with arrears. (c) Direct the Respondents to pay interest at 9% per annum on delayed payments of DA to compensate for inordinate delay. (d) Pass any other relief(s) which this Hon'ble Court may deems fit and proper in the facts and circumstances of the present case in favour of the Petitioner and against the Respondents."

Administrative Tribunals Act, 1985 and the dispute raised herein falls within the jurisdiction of the Central Administrative Tribunal. In view of the decision of the Supreme Court in L. Chandra Kumar v. Union of India,1 the Petitioner has an efficacious alternative remedy before the Tribunal, and therefore, the writ jurisdiction of this Court cannot be invoked at the first instance.

In view of the above, counsel for the Petitioner seeks leave to withdraw the present petition with liberty to approach the Central Administrative Tribunal, in accordance with law. 4.

Leave and liberty as prayed for are granted.
