The petitioners have filed the present petition seeking transfer of proceedings arising out of Criminal Cases No. 590/2026 [State v. Yash Kumar], pending before the Judicial Magistrate First Class-04, District Shahdara, Karkardooma Courts, Delhi, to any other District Court in Delhi.

An earlier petition filed on the same grounds was disposed of by this Court, vide order dated 19.03.2026 [TR.P.(CRL.) 20/2026], in the following terms:
"1.
The petitioner has filed the present petition seeking transfer of proceedings arising out of Criminal Case bearing No. 590/2026 [State v. Yash Kumar], pending before the Judicial Magistrate First Class-04, District Shahdara, Karkardooma Courts, Delhi, to any other District Court in Delhi.

The allegation in the present petition is that the petitioners were threatened by respondent No. 2 - complainant, who is himself an advocate at Karkardooma Court, and his associates, when they attended the Court proceedings on 24.02.2026. 3.
The petitioners have also made a complaint to the learned Principal District and Sessions Judge, District Shahdara, Karkardooma Courts, Delhi, seeking transfer of the case. 4.
At this stage, Ms. Deepika Garg, learned counsel for the petitioners, submits that the petitioners would be satisfied with a direction upon the concerned Investigating Officer to ensure that they are able to attend the proceedings in the criminal case, without TR.P.(CRL.) 34/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. intimidation or threat from respondent No. 2 or any other party. 5.
Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, states that the concerned Station House Officer will be instructed accordingly.

The transfer petition, alongwith pending applications, is disposed of in terms of the above submissions, without prejudice to the rights of the petitioners to approach the Court afresh in the event of any subsequent necessity.

It is made clear that respondent No. 2 has not been issued notice, and the observations made in the present order are not intended to make any comment upon the merits of the allegations levelled by the petitioners."

Ms. Deepika Garg, learned counsel for the petitioners, submits that, pursuant to the aforesaid order, the petitioners made requests to the Station House Officer ["SHO"], P.S. Madhu Vihar, and the Deputy Commissioner of Police ["DCP"], District East, on 26.03.2026 and 27.03.2026, respectively, in view of the next date of hearing before the Trial Court on 01.04.2026. However, no assurance was given to them, which necessitated their appearance by video conference. 4.
The proceedings are next scheduled for tomorrow, i.e., 10.04.2026, and Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, assures this Court that the order dated 19.03.2026 shall be complied with in letter and spirit.

The petition, alongwith the pending applications, is accordingly disposed of in terms of the above assurance, reiterating the order dated 19.03.2026.

A copy of this order be communicated by Mr. Chauhan to the concerned SHO and the concerned DCP.
