versus UNION OF INDIA THROUGH ITS SECRETARY MINISTRY OF LABOUR & EMPLOYMENT AND ORS.

..... Respondents Through:

Mr. Amit Kumar, Adv. for R-1.

Ms. Inderjeet Sidhu, Adv. for R-2.

CORAM:

HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 28.02.2020 The petitioners are aggrieved by non-deposit of their provident fund contribution by their employer i.e. respondent nos. 3 and 4, with respondent no. 2-Regional Provident Fund Organisation (RPFO). Their representation to the RPF Commissioner on 30.07.2019, has not been responded to. This is odd because when an aggrieved workman seeks information about his rights and/or compliance of statutory obligations by the management, it is imperative that the statutory authority responds to his application. Seven months have gone by and the petitioners have not received any response whatsoever.

In the circumstances, this petition shall be treated as petitioners' representation by respondent no. 2. The latter is directed to take appropriate measures as per law by 16.03.2020 and intimate the petitioners accordingly. The petitioners shall be given hearing by respondent no. 2 on 04.03.2020.

The petition is disposed-off in the above terms. KUMAR 15:37:03
