Learned counsel for the respondent submits that an unconditional leave was granted by the learned ADJ in the suit, which has been impugned before this Court by the petitioner. Learned counsel further submits that the matter has reached at the final stage of hearing and written submissions have been filed by the parties, therefore, the present petition has become infructuous.

Learned counsel for the petitioner has also not disputed that the case is at the stage of final arguments, however, he submits that one application under Section 152 read with Section 151 of Code of Civil Procedure, 1908 for putting exhibits on certain documents is yet to be disposed of by the learned Trial Court and directions be issued to the learned Trial Court to dispose of the said application also expeditiously and further seeks liberty to withdraw the present petition.
