O R D E R

% 27.01.2017 Issue notice. Notice is accepted on behalf of the State. The status report tendered in court is taken on record. The petitioner is seeking parole so as to prefer a Special Leave Petition against the judgment of this court dated 12.07.2016 dismissing his appeal. The petitioner is serving a sentence of 10 years rigorous imprisonment with fine in case FIR 245/2011 under Section 376(2(f)/506 IPC. The petitioner has undergone 5 years 5 months and 4 days incarceration as on 03.01.2017. He was granted interim bail earlier and it is not reported that he has misused the said liberty. The ground for rejection of his application for parole by the State was that his address could not be verified. Since the address has now been

verified and the jail conduct of the petitioner is satisfactory, I am inclined to allow this petition.

In these circumstances, the petitioner is directed to be released on parole for a period of two weeks subject to:

i) his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; iv) he shall duly surrender at the end of the period of parole; v) he shall not establish any contact with the victim or her family members, and shall also not indulge in any criminal activity while on parole;

vi) the proof of filing of Special Leave Petition be provided to the Jail Superintendant.
