% 24.05.2019 CM APPLN. 25190/2019 Vide the present application, the applicant/petitioner seeks permission to withdraw the present petition with liberty to approach the Rajasthan State Pollution Control Board for a no-objection certificate stating therein that there was no increase in the pollution load in the years 2002-2008 as sought by the respondent-Union of India in paragraph XI-XIII of its counter affidavit dated 13.05.2019.
He further seeks permission for permitting the applicant/petitioner to file a fresh petition inter-alia for the same relief for or on account of such other cause of which action may arise or remain in this regard. The application is allowed.
Permission is granted, with liberty as prayed.
Needless to say that the permission is not being granted on the merits of the present petition.
The petition is disposed of.
