W.P.(CRL) 1137/2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner had sought parole on the ground that his wife requires gallstone surgery.

In the meantime, however the wife is stated to have undergone the surgery.

Notice on this petition was issued on 09.04.2026. 4.

been placed on record. The said document is a discharge slip from Maharishi Valmiki Hospital, Delhi, which records that the petitioner's wife was admitted on 20.04.2026 and was discharged on 21.04.2026, whereafter she was called for review and dressing; and was advised rest for 02 weeks.

Learned counsel for the petitioner submits, that there is no one in the family to look-after the wife in the post-operative period. 7.

Learned ASC appearing for the State disputes the submissions, stating that the petitioner's parents and brother alongwith their children reside at the same address and are capable of taking proper care of the petitioner's wife.

Counsel for the petitioner also submits, that the petitioner's father is aged and his brother has his own family to look-after. 9.

Though no compelling ground is made-out, it is noticed that the petitioner has undergone more than 12 1⁄2 years of custody; that his jail conduct has been satisfactory; and he is working as 'ward sahayak'. 10.

Furthermore, the petitioner was granted parole on 02 occasions and furlough on 10 occasions, though he had jumped parole for which he was arrested in 2019.

Nevertheless, purely on humanitarian considerations, the petitioner is granted parole for 01 week from the date of his release, subject to the following conditions :

11.1. The petitioner shall furnish a personal bond in the sum of Rs.25,000/- (Rs. Twenty-five Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;

11.2. The petitioner shall not leave the State of Delhi without permission of the court and shall ordinarily reside at the address as per prison records/as mentioned in the petition ; 11.3. The petitioner shall furnish to the S.H.O., P.S.: Punjabi Bagh, Delhi a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times ;

11.4. If the petitioner has a passport, he shall surrender the same to the the Jail Superintendent;

11.5. The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any ;

11.6. Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.

The Registry is directed to communicate a copy of this order to the concerned Jail Superintendent forthwith.

Let a copy of this order be given dasti under the signatures of the Court Master.

The petition is disposed-of in the above terms. 15.
