% 27.04.2017 Against impugned order of 1st September, 2016, petitioner had already preferred an appeal, but no interim orders were passed. While entertaining this petition, trial court was directed to decide petitioner's application for waiver of pre-deposit and operation of impugned order of 1st September, 2016 was stayed.

Learned counsel for parties inform that Appellate Court vide order of 13th April, 2017 has dismissed petitioner's application for waiver of pre-deposit with direction to petitioner to deposit 50% of the demanded amount.

Learned counsel for petitioner submits that though this petition has become infructuous but it needs to be clarified that subject to 50% of the demanded amount, there shall be stay of order of 1st September, 2016. In view of aforesaid, this petition and the application are disposed W.P.(C) 502/2017

of as infructuous with clarification that subject to petitioner depositing 50% of the demanded amount within four weeks, there shall be stay of order of 1st September, 2016 during the pendency of petitioner's appeal. (SUNIL GAUR) JUDGE APRIL 27, 2017 s W.P.(C) 502/2017
