This order is in continuation of the earlier order dated 15th March, 2019.

The counsel for the plaintiff, on enquiry states that the plaintiff has seen the film 'KESARI' and she has instructions to withdraw the suit. 3.
The suit is dismissed as withdrawn.

The counsel for the plaintiff seeks refund of court fees, arguing that since notice of the suit has not been issued, at least 50% of the court fees be refunded.
5.
The plaintiff having taken a chance by instituting a suit to put a spoke in the release, then imminent of the film 'KESARI', cannot on failing in the same seek refund of court fees. If such refunds are permitted, the litigants would take a wager on the Court and which would be in abuse of the process of the Court. Hence, the request for refund of court fees is rejected.
