W.P.(C) 2397/2020 The petitioner is aggrieved by the order dated 13.02.2020 passed by the North Delhi Municipal Corporation, asking her to vacate the premises i.e. Property No. WZ-4, First and Second Floors, Hari Singh Park, New Multan Nagar, Delhi-110056, within 48 hours thereof. She is stated to have been living in the premises for almost four decades and she has nowhere to go. It is her grievance that she was never heard by the appropriate KUMAR 15:10:19
Authority.
On a query put to the learned counsel for North Delhi Municipal Corporation, as to whether the petitioner was heard by the Corporation or by appropriate Authority, the answer is in the negative. That being the position, the petitioner's eviction from the place, where she has been residing as a resident for almost four decades, is in denial of natural justice. In the circumstances, the respondents shall grant a hearing to the petitioner before she is evicted from the premises. The hearing shall be scheduled for 20.03.2020 and the decision shall be communicated to the petitioner on or before 25.03.2020. Till then, the respondents shall not take any coercive measures against the petitioner. The writ petition is disposed-off in terms of the above.
