IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 2395/2020 SAROJ DEVI & ANR ..... Petitioner Through Mr.(name not given), Adv.

versus TEHSILDAR/CONSOLIDATION OFFICER..... Respondent Through Mr.Anjum Javed, ASC, GNCTD with Mr.Devendra Kumar, Adv.

CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 02.03.2020 This Writ Petition is filed seeking to impugn the notice dated 15.2.2020 passed by the Consolidation Officer whereby the respondent issued notice for withdrawal of allotted plots. The case of the petitioner is that the consolidation scheme took place in 1996.

The respondent/predecessor was allotted a land allegedly sometimes in 1998. The petitioner had purchased this land by sale deed in 2010. It is stated that in the meantime construction has also been carried out. The grievance of the petitioner is that now after lapse of so much of time the impugned show cause notice has been issued.

A perusal of the notice shows that it is only a notice and the petitioner has been asked to submit reply and documents by 3.3.2020. Let the petitioner submit his reply and supporting documents to the concerned Tehsildar. The Tehsildar will also give a personal hearing to the petitioner. It is only after a personal hearing is given that the Tehsildar will pass a reasoned order on the show cause notice.

Nothing further survives in this petition. Liberty is granted to the petitioner to challenge the order of the Tehsildar, if for some reason he is not satisfied with the same.

Petition stands disposed of.

All pending applications, if any, also stand disposed of accordingly.
