% 27.04.2026 1.

On 09.04.2026, the following order was passed: "1. By way of the present Petition, the Petitioner prays for issuance of a Writ in the nature of Mandamus for re-fixation of his pay because his basic pay was reduced from Rs.75,320/- p.m. to Rs.69,000/- p.m., without issuing any show cause notice.

2. The Petitioner herein is a former employee, who has already retired on 31.08.2025 after attaining the age of superannuation.

3. The Petitioner has stated to have made multiple representations, which have not been considered.

4. Learned counsel representing the Respondents submits that he will instruct the Competent Authority to consider the Petitioner's representation.

The learned counsel representing the Respondents does not dispute that the re-fixation of the Petitioner's pay was carried out without issuing any show cause notice. Petitioner was being paid ₹69,000/- per month continuously and errantly he was paid ₹75,320/- only for a period of one month. He further submits that at present, no recovery against the Petitioner is envisaged.

Be that as it may, once an order adversely impacting the Petitioner is required to be passed, a show cause notice is required to be issued to give an opportunity to the Petitioner to represent his case. 4.

Keeping in view the aforesaid facts, the writ petition is disposed of while directing the Respondents to pass a speaking order after granting an opportunity of hearing to the Petitioner within a period of one month from today.
