During the course of the arguments learned counsel appearing on behalf of the petitioner has submitted that the petitioner is only pressing for the relief of expeditious disposal of the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure, 1908 ('CPC') pending before the learned trial Court.

Keeping in view the facts that the learned trial Court is proceeding with the matters in accordance with its own board, after keeping in view the pendency and age of the cases before it.
