Issue notice to the respondents.

Ms. Arunima Dwivedi accepts notice on behalf of the respondents. 3.

With the consent of learned counsel for the parties, the writ petition is taken up for hearing and final disposal.

The substantive prayer made in the writ petition is as follows : "(a) issue an appropriate writ[s]/direction[s] or order[s] directing the NRC/WRC to decide the application of the petitioner institution for issuance of final recognition before cut off date of 03.03.2020 or in its next meeting and as per SOP dated 07.05.2019 issued by the NCTE."

A perusal of the prayer would show that the petitioner seeks the direction that a decision on its application, which is, pending consideration before the concerned regional committee be taken. 5.1 To be noted, the petitioner had filed an application as far back on 31.12.2012 for being granted recognition qua D.E.C.Ed. course. W.P.(C) 2435/2020

It appears that the Northern Regional Committee (NRC) processed the matter concerning the petitioner and issued a show cause notice dated 01.03.2019 pursuant to an order of remand passed by the Appeal Committee of the NCTE dated 24.07.2018.

6.1 The petitioner avers that a reply dated 08.04.2019, to the show cause notice, was filed.

6.2 It is, thus, the grievance of the petitioner that thereafter, there has been no movement in the matter.

In the meanwhile, the NCTE has issued a gazette notification dated 27.01.2020 whereby qua the institutions which are located in the State of Rajasthan, jurisdiction has been vested in the Western Regional Committee (WRC).

A perusal of the record shows that while there has been a delay by the respondents in processing the petitioner's application, a part of the fault, if not the entire fault, lies with the petitioner as well inasmuch as the petitioner has not shown alacrity in approaching the court. 9.

The cut-off date for academic session 2020-2021 is 03.03.2020. The petitioner has approached this court practically at the nth hour. 10.

Accordingly, the captioned writ petition is disposed of with a direction to the concerned regional committee i.e. NRC/WRC to process the petitioner's application with due expedition. 11.
