The counsel for the defendant is also not available and Mr. Kalyan Arambam, Advocate appearing on his behalf seeks passover. 3.

Considering the reason for which the suit is listed today, need to passover is not felt.

Admittedly the suit in accordance with Office Order dated 24th November, 2015 of Hon'ble the Chief Justice in exercise of powers under Section 4 of the Delhi High Court (Amendment) Act, 2015 is liable to be transferred to the subordinate courts. However the Joint Registrar has listed the same before this Bench owing to a controversy as to the District to which the suit is to be transferred.

Though the counsel now for the sole defendant M/s. Crompton Greaves Ltd. had appeared before the Joint Registrar stated that the defendants do not have office in Delhi but today states that the address of CS(OS) No.1920/2003

the sole defendant M/s. Crompton Greaves Ltd. is at Kasturba Gandhi Marg, New Delhi.

The suit as well as Counter Claim are transferred to the Court of the District Judge, New Delhi, Patiala House Courts, New Delhi. 7.
