Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, to direct the Respondent Nos. 1 to 3 to produce the records in respect of the Complaint dated 14.06.2023 sent on 17.06.2023, duly delivered to the Respondent Nos. 1 to 3 and to initiate an inquiry against the Respondent Nos. 4 to 6 for lodging a false FIR No. 0602/2022 dated 9.9.2022 under Section 448 read with Section 34 IPC, registered against the petitioners or the Respondent Nos. 5 to 6 have no right, title or interest in the property in question. 2.

On advance Notice, learned ASC (Crl.) has appeared and accepted the Notice on behalf of the State.

father was allotted a plot by Gaon Sabha for nine years lease for the welfare of the weaker sections. On 26.01.2013, the mother of the Petitioner No. 1 and the Respondent No. 6, Late Parmeshwari Devi died. Thereafter, on 08.01.2007, the father of the Petitioner No. 1, Shri Balwant Singh died having behind three sons. Shri Balwant Singh was also having a house bearing No. WZ-430. On 07.10.2022, the Petitioners made a representation to the Respondent Nos. 1 to 4. Thereafter, on 14.06.2023, a Complaint was made by the Petitioners to the Respondent Nos. 1 to 3. 5.

On 09.09.2022, on the Complaint of the Respondent Nos. 4, 5 and 6, FIR No. 0602/2022 under Section 448/34 of IPC, got registered at Police Station Palam Village, Palam, New Delhi.

It is submitted on behalf of the Respondent No.2 that the matter apparently has been settled inter se the parties vide Memorandum of Settlement (MOU) dated 04.09.2024. The copy of the said MOU is taken on record. In the Settlement, it was inter alia settled between the parties that the Petitioners shall withdraw their claims for possession, ownership, title on the property bearing Plot No. E-587, Khasra No. 34/1, measuring 115 sq. yards, to the Respondents at the time of execution of the present MOU. It is also settled between the parties that the Respondents shall pay a sum of Rs.30,00,000/- to the Petitioners, by way of Demand Draft/cheque in the name of father/husband, Mr. Naresh Kumar Kashyap, as full and final amount towards all claims etc. It is also settled between the parties that they shall not file any complaint or initiate any legal proceedings against each other at any point of time in future qua the present dispute. 7.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering that both the parties have settled the matter vide MOU dated 04.09.2024, the FIR No. 0602/2022 under Section 448/34 of IPC, registered at Police Station Palam Village, Palam, New Delhi and all the consequential proceedings emanating therefrom are quashed. 10.

The Petition is disposed of accordingly.
