% 11.03.2020 This petition is for quashing of FIR No.354/2014 filed under Section 182/192/203/211/285/286/287/497/120B/34 of IPC. The status report has been filed. An FIR has been registered in a complaint case under Section 156 (3) Cr.P.C. by the respondent no.2 herein. The matter has been amicably settled between the complainant and his wife namely Ms.Pooja Sharma. However one co-accused Mr.Deepak Rana with whom the complainant had alleged his wife to be in friendly relations with, has not been made a party to this petition. The learned counsel for the applicant submits he is not residing in India and his whereabouts are not known and the complainant himself has made a statement on 27.08.2019 in Criminal Revision No.35/2019 that he has no objection in case the FIR is quashed, hence there is no need to wait for Mr.Deepak Rana and FIR can be quashed at this stage.

Admittedly closure report was filed by the appellants before the learned Trial Court in the year 2016. However on objections by respondent no.2/husband, the Court ordered for re-investigation. It is stated yet again closure report is ready to be filed within a week from today before the learned Trial Court. Since the closure report is to be filed in near future, hence there is no need to keep this petition pending and is disposed of with a liberty to the petitioners to file afresh after impleading all the parties, if need arises. Pending application(s) also stands disposed of.

However at this stage it is submitted the petitioner no.1 Mrs.Pooja Sharma is leaving India to pursue her service in New Zealand. The learned APP as well as complainant has no objection to the same.
