The present writ petition has been filed seeking a direction to the respondents no.1 and 2 to restrain respondents no.3 and 4 from undertaking any illegal and unauthorized construction/demolition in property bearing no.18-22, Gandhi Gali, Fatehpuri, Delhi-110006 (hereinafter 'subject property').

It is contended on behalf of the petitioner that there is a common wall which separates the subject property from the property of the petitioner and if demolition exercise is carried out, it will affect the structural integrity of the wall and grave damage would be caused to the property of the petitioner. A work-stop notice had been issued by respondent no.1/MCD to respondent no.2 on 1st May, 2025 directing stopping of any unauthorized construction at the subject property.

Counsel appears on behalf of respondent no.2/SHO, Police Station: Lahori Gate and submits that no demolition exercise is being carried out in the subject property. He submits that a few days back, some material had dropped from the roof top of the subject building. 5.

In view of the aforesaid submissions, the present writ petition is disposed of while directing respondents no.1 and 2 to ensure that the structural integrity of the wall marked with red colour on the site plan (at Annexure-P1) of the subject property is not compromised, weakened or demolished by any action of the private respondents. 6.
