The present petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No.977/2022 registered under Sections 376(2)(n)/506 IPC at P.S. Nihal Vihar on the assertion that respondent No.2 does not wish to pursue the present FIR.

Considering that the case relates to the offence punishable under Section 376 IPC, learned counsel for the petitioner, on instructions, seeks leave to withdraw the present petition with liberty to file afresh a petition on merits.
