% 18.03.2019 After some hearing, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition, the petitioner seeking liberty to file afresh after leave has been granted in Crl. Leave Petition no. 12/2018 whereby challenge has been brought to the judgment dated 29.08.2017 in the cross case arising out of FIR no. 18/2014 of police station Malviya Nagar against the second respondent.

The petition and the application filed therewith are dismissed as withdrawn. Liberty as prayed for, granted.
