The petitioners have filed the present petitions, inter alia, praying that the Civil Suit bearing No. CS DJ No.48/2016 be transferred from the Court of the learned Additional District Judge-01 (North East) to the learned Principal Judge, Family Court. The petitioner also prays that the Execution Petition No.761/2018 and the Execution Petition no.123/2017, filed in connection with the orders passed in the said suit, be also transferred to the concerned Principal Judge, Family Courts.

The plaintiffs have filed the said suit under Section 18 and 20 of the Hindu Adoption and Maintenance Act, 1956, seeking maintenance from the defendant herein. Undisputedly, the said matter falls within the jurisdiction of the Family Courts.

In view of the above, these petitions are allowed. The Civil Suit bearing no. CS DJ No.48/2016, Execution Petition No. 761/2018 and Execution Petition no.123/2017, which are currently pending before the learned District Judge, North East are transferred to the Principal Judge, Family Courts, North East, Karkardooma Court Complex. 4.
The parties are directed to appear before the concerned Court on 01.06.2019.
