Applicant seeks anticipatory bail in case arising out of FIR No. 207/2026 dated 03.04.2026, for commission of offences under Sections 115(2)/332(c)/324(5)/351(2)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 323/451/506/34 IPC), registered at P.S. Vasant Kunj South.

Learned counsel for the complainant has joined the proceedings through video conferencing and learned APP for State is also present along with IO.

During course of arguments, the CCTV Footage in question has been shown and played.

Such CCTV footage, though, indicates that Davesh Malik had also entered into the store, there is no specific overt act attributed to him, at least BAIL APPLN. 1400/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

He is 32 years old, with no past antecedents of any nature whatsoever. He is married and having two children.

The main accused i.e. Ashish has already been arrested and is in judicial custody.

Keeping in mind the overall facts of the case, albeit, without expressing any opinion over the merits of the case as such, the present application is disposed of with direction that the applicant shall join the investigation as and when so directed by the prosecution and fully assist the Investigation Agency. In the event of his arrest, the applicant be admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- subject to the satisfaction of the concerned SHO/IO/arresting officer.
