Counsel for the appellant states that subsequent to filing of this appeal, the respondent's trademark has since got registered. The appellant had preferred this appeal against the rejection of their opposition filed to the said respondent's application for registration.

In this view of the matter, the counsel for the appellant seeks to withdraw the said appeal with liberty to file a rectification petition in respect of the respondent's mark which has now registered. 3.

The appeal is dismissed as withdrawn.
