This petition is filed for quashing FIR No. 113/2021 PS Paschim Vihar under Sections 498A/406/376/376D/34 IPC on grounds of settlement arrived at between the parties on 8th March 2024.

The issue had arisen relating to marital discord between petitioner no.1 and respondent no.2 who are living separately with effect from 12th September 2018. Parties have now mutually settled their disputes and as per the settlement, respondent no.2 has already received Rs.3 lakhs, which she confirms.

Petitioner no.1 and respondent no.2 are present and duly identified by the IO. Petitioner nos. 2 and 3 are present through VC and are duly identified by the IO.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, FIR No. 113/2021 PS Paschim Vihar under Sections 498A/406/376/376D/34 IPC and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 7.

Accordingly, the petition is disposed of along with pending applications, if any.
