The present writ petition has been filed seeking a direction to respondent/MCD to inspect property bearing No. C-40, Abul Fazal Enclave Part-1, Jamia Nagar, New Delhi and to stop the ongoing illegal construction in the subject property. Photographs have been filed with the petition to show the ongoing construction.

Mr. Siddhant Nath, appearing on behalf of the respondent no.1/MCD on advance notice, submits that the demolition order has been passed in respect of the unauthorised construction in the subject property after W.P.(C) 4762/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. following due process of law. He further submits that a demolition action has been planned on 23rd April, 2026.

Mr. Nath also submits that two communications have been sent by the MCD to the concerned Police Station, calling upon the police authorities to stop ongoing unauthorised construction. However, no action has been taken by the police authorities.

In view thereof, the present writ petition is disposed of while taking the statement of MCD on record that the demolition action has been planned on 23rd April, 2026.

A direction is issued to the concerned SHO, Police Station Shaheen Bagh, to provide the necessary police force so that the proposed demolition action can be carried out.

A further direction is issued to the SHO, Police Station, Shaheen Bagh Police, to ensure that no unauthorised construction is carried out in the subject property.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the owner/occupier/private respondents are kept open.
