This is a petition filed on behalf of the Petitioners under Section 482 Cr.P.C. seeking quashing of FIR No. 549/2019 dated 31.08.2019 under Sections 498A/406/34 IPC registered at PS: Bhalswa Dairy. 2.

While the entire averments in the petition are aimed at stating that parties have now separated and amicably settled their disputes, strangely, there is no written settlement Agreement. It further needs to be noted that the affidavit filed on behalf of Respondent No. 2 in support of the petition in paragraph 2 contains a statement 'deponent and Petitioner No. 1 are residing together'. It is therefore not understood whether the parties have settled the matter to live together or to live separately. 3.

At this stage, learned counsel for the Petitioner seeks to withdraw the petition with liberty to file a fresh petition bringing forth the correct facts.
