By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks quashing of FIR No. 312/2023, dated 25.07.2023, lodged at Police Station Farsh Bazar, under Sections 354(A)/34 of the Indian Penal Code, 1860 and Sections 10/12/17 of the Protection of Children from Sexual Offence Act, 2012. 2.

After some arguments, Mr. Sandeep Singh Hora, learned counsel for the petitioner, seeks permission to withdraw this petition, without prejudice to the rights and contentions of the petitioner before the Sessions Court, including the right to make a discharge application before the Sessions Court.

It is made clear that this Court has not made any observation touching upon the merits of the matter and it is for the concerned Court to take appropriate decision in accordance with law.
