An affidavit in compliance of the order dated 17.09.2025 has already been filed by the respondent, which is forming part of the record of this Court.

A perusal of the aforesaid affidavit reveals that the averment qua "except in any compelling/ exceptional circumstances like losing a job, any mishappening or unhappy incident took place etc." has been wrongly inserted by the respondent in paragraph 5 of the said affidavit as nothing of such nature was either mentioned or recorded while passing the order dated 17.09.2025.

In view of the clarification provided hereinabove, learned counsel for the petitioner submits that since there is nothing surviving in the present petition, he seeks to withdraw the present petition. 5.

Accordingly, the present petition alongwith the pending application stands dismissed as withdrawn.
