On the last date of hearing, noticing the absence of the appellant, court notice was directed to be issued to the appellant. As per the report, the appellant is stated to have expired. The report is on the basis of process server. As per which, he had visited the address of the appellant where he met one Mrs. Sushila, the wife of the appellant. She had stated that her husband had expired on 25.07.2024. Despite being aware of the same, no further step been taken.

In view of the above, the present appeal is disposed of as infructuous.
