Applicant seeks regular bail in case arising out of FIR No. 551/2024, for commission of offences under Section 109(l) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Section 307 IPC) & 25/27 Arms Act, 1959, registered at PS Pahar Ganj, Delhi.

It is contended that the applicant is in custody since 24.09.2024 and, moreover, as per the prosecution's story, though, it is a case of attempted murder, nobody received any injury.

Learned counsel for applicant submits that two co-accused, whose roles are more or less similar, are already on bail. 4.
As per learned APP for State, information about the abovesaid incident was received on 22.09.2024 through a PCR call and when police reached at the spot i.e. Aanchal Guest House situated in Paharganj, the caller-Mr. Rajiv Bedi, stated that he heard gun-shot and that some persons had fled from the spot, after firing.

two persons who received injuries in the abovesaid incident i.e. Anas and Naved and their statements were recorded and they were also got medically examined at Lady Harding Hospital, Delhi.

According to their statements, there was some altercation a day before the date of incident with one person and that the same individual (name later on ascertained to be Shanu) came at the spot next day with three associates. They assaulted them and one of them was having a pistol. Applicant-Suhail is stated to be the one who was carrying pistol which he handed over to Shanu and, though, Shanu fired with the help of such weapon, fact remains, that such bullet struck the ground and did not injure anyone. 7.
Thereafter, all the four accused persons fled from the spot. 8.
Admittedly, two of the accused persons i.e. Md. Dilshad and Deepak are already on bail.

Shanu continues to be in judicial custody.

Charges have already been ascertained on 02.08.2025. 11.
So far no prosecution witness has entered into witness box. 12.
Keeping in mind the overall facts of the case, albeit, without making any final observation on the merits of the case, the applicant is admitted to bail, on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:- (i) The applicant would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court.

The present bail application is disposed of in aforesaid terms. 14.
