1. The present petition has been filed under Section 407 CrPC seeking transfer of complaint case No. 23831/2018 titled "Capt. Priyanka Yadav Vs. Karan Mann &Anr." under Sections 199/200 CrPC for offences punishable under Sections 499/500/501/34 IPC.
2. As per the complaint, the Petitioner's brother-in-law invested money with Ms. Kanika Maan, however, the same amount was manipulated with by the Respondent No.1 herein. It is alleged that the Respondent No.1 subsequently fraudulently transferred the entire business to himself.
3. Learned counsel for the petitioner submits that the complaint is pending before the Ld. M.M., South-West, Dwarka Courts New Delhi, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
and prays for the same to be transferred to the competent Court i.e., Saket (South District) under P.S. Safdarjung Airport, New Delhi, to avoid any technical objection at a later stage.
4. It is also stated by the petitioner that the respondents herein have not been summoned by the Ld. M.M. and the matter is still at the stage of pre-summoning evidence.
5. The Ld. M.M., South-West, Dwarka Courts New Delhi, vide its order dated 23.01.2021 inter alia mentioned that none of the alleged offences have taken place within the jurisdiction of Dwarka Courts and let the matter be transferred to the concerned court having jurisdiction.
6. Learned Registrar General has placed this matter before this court in terms of the directions of Administrative and General Supervision Committee dated 15.04.2019. In view of the report of learned Registrar General, learned M.M., South-West, Dwarka Courts, New Delhi is directed to send all records to Saket Court (South District), New Delhi.
7. The present petition is allowed and accordingly, the complaint case No. 23831/2018 is transferred to the requisite court having the jurisdictional authority over the present matter i.e. Saket Court (South District), New Delhi. Learned Principal District and Sessions Judge (South), Saket Court is requested to assign the Complaint Case to the court of competent jurisdiction.
8. Parties are directed to appear before learned Principal District and Sessions Judge, Saket Court (South District), New Delhi on 31.07.2024.
