O R D E R

% 24.05.2018 The appellant has been convicted under Section 376(2)(f) IPC. We have heard learned APP and learned counsel for the convict on the aspect of sentencing.

The submission of counsel for the convict is that he is 29 years old; he is married with a five year old son; he has not been involved in any other offence, and; and he has already undergone about four years incarceration between 2012 and 2016.

Considering the aforesaid circumstances, the convict is sentenced to 10 years rigorous imprisonment with fine of Rs.5,000/-. In the event of default of payment of fine, the convict shall undergo further simple

imprisonment for a period of three months. He shall be entitled to the benefit of Section 428 Cr PC.
