This is a contempt petition filed by the petitioner under Section 12 of Contempt of Court Act, 1971 seeking the following prayers :- "a. Issue appropriate directions/orders to initiate contempt against the Respondents in the matter, and/or;

b. Issue appropriate directions/orders to the Respondent/s to strictly comply with the Order dated 25.03.2026 passed by this Hon'ble Court in Writ Petition no. 3906 of 2026, and/or; c. Issue appropriate directions/orders directing the Respondent(s) to forthwith restore the Bank Guarantee(s), in the event the same have been encashed, in violation of the order of this Hon'ble Court d. of the present petition, to restrain Respondent HSCC from appropriating, transferring or in any manner dealing with the sums received from Respondent bank pursuant to the encashments, in the event the same have been encashed, in violation of the order of this Hon'ble Court and;..." 2.

Mr. Aggarwal, learned counsel for the respondent Nos. 1 to 4, states that in the present case, the Bank Guarantees were already encashed when the order dated 25.03.2026 was passed.

The portion of the bank guarantee was encashed on 24.03.2026 and the balance was encashed on 25.03.2026 at 12:29 p.m. before the order was communicated.

For the said reasons, the contempt shall not lie as there is no violation of the order dated 25.03.2026.

The petitioner is at liberty to initiate appropriate legal proceedings in accordance with law.

The proof showing encashment of bank guarantee shall be supplied to the counsel for the petitioner and shall be placed on record of the court file within one week from today.
