In terms of order dated 13.05.2024, Mr. Bhim Sen Malhotra, petitioner appears in person. He affirms that the petitioner and respondent no.3 have entered into a written agreement annexed to the application bearing CM APPL. 28363/2024. He affirms his signatures on every page of the said agreement.

He submits that in terms of the Settlement Agreement dated 29.03.2024, the respondent no.3 was to pay to the petitioner a sum of Rs.22 Lacs full and final of the Settlement Terms. He submits that out of the said amount, he has already encashed a sum of Rs.11 Lacs worth of cheques. The Post Dated Cheques in respect of the balance amount is in his possession. He submits that he does not wish to continue with the present writ petition in terms of the Settlement Agreement. He seeks permission to withdraw the present writ petition on that ground. 4.
The settlement is taken on record and marked as Ex.P-1. 5.
Keeping in view the aforesaid Settlement Agreement as also the submissions made by Mr. Bhim Sen Malhotra, petitioner in person, binding the parties to the terms of Settlement, the present writ petition is dismissed as having been settled between the parties. The pending applications also stand disposed of accordingly.
