O R D E R

% 30.01.2020 On behalf of the petitioner has been produced the receipt of deposit of cost of Rs.10,000/- in terms of directions dated 03.12.2019. Learned counsel for the petitioners seeks to withdraw the present petition seeking liberty to file it afresh in the event of the provisions of Section 320 of the Cr.PC, 1973 not being invoked in the matter despite a settlement arrived at between the parties.

In as much as the FIR registered bearing no.138/2018, PS Chitranjan Park is one under Section 420 r/w Section 34 of the Indian Penal Code, 1860 with the offence punishable under Section 420 of the Indian Penal Code, 1860 being compoundable per se, the petition is dismissed as withdrawn with liberty granted as prayed without any observations on the merits or demerits of the prayer, if any, that is made before the learned trial Court in as much as it is submitted on behalf of the State that the investigation is not yet complete.
