BAIL APPLN. 691/2019 The petitioner is described in the case for prosecution arising out of FIR No.274/2017 of Police Station Jahangirpuri, involving offences punishable under sections 120-B/328/307/452 of the Indian Penal Code, 1860 (IPC) as the paramour and accomplice of co-accused Meenakshi, she being the wife of Anoop Yadav (PW-4) and daughter-in-law of Narayani Devi (PW-3). The said two witnesses are described as the victims of the alleged offence of attempt to commit murder, it being attributed to the petitioner that he aided and assisted by co-accused had slit the throats of the said persons with knife while they were sleeping. and PW-4 brings out evidence affirming the presence of the petitioner with co-accused Meenakshi in the house of the victims on the night in question, PW-3 being categorical that she had seen the petitioner using the knife to slit her throat and the throat of PW-4, similar testimony having been given by the latter.

It is argued by the petitioner that the statements were given after inordinate delay of twenty-five days. This is not the stage to subject the evidence being adduced at the trial of such acute scrutiny so as to find justification or otherwise for delay, the medical opinion about the state of the two victims being yet to be brought on record. No good ground to release the petitioner on bail.

The petition is dismissed.
