This order is in continuation of the orders dated 18th July, 2016, 22nd August, 2016 and 19th September, 2016.

The counsel for the defendants No.1&2 states that the probate petition pending before the Court of the Additional District Judge, Tis Hazari Courts, Delhi is now listed for pronouncement of orders on 4th October, 2016. 3.

This suit was transferred to the District Judge (South) on the statement of the counsel for the defendants that the probate proceedings were pending before that Court.

The District Judge (South) has reported that the property subject matter of the suit is situated within the jurisdiction of District Judge (SouthEast), Saket Courts, New Delhi. 5.

Since the probate proceedings are near culmination, there is no need for the suit being transferred to the same district where the probate proceedings are pending.

In accordance with the territorial jurisdiction, the suit is now transferred to the Court of District Judge (South-East), Saket Courts, New Delhi.
