The present petition is filed challenging the judgment dated 06.04.2024 (hereafter 'impugned judgment'), passed by the learned Additional Sessions Judge ('ASJ'), Dwarka Courts, Delhi, in CA No. 84/2024.

By the impugned judgment, the learned ASJ dismissed the appeal filed by the petitioner against the judgment of conviction dated 19.09.2023 and order on sentence dated 01.12.2023, passed in Ct Case 31759/2019, on the ground of delay.

By the judgment of conviction dated 19.09.2023, the petitioner was convicted for offence under Section 138 of the Negotiable Instruments Act, 1881. to undergo simple imprisonment for a period of one year and to pay a fine of ₹2,20,000/- as compensation to the complainant within 30 days of passing of the order, and in default of payment of fine, to further undergo simple imprisonment of two months.

The respondent no.2 is present before this Court today and states that he has settled the dispute voluntarily for a sum of Rs.1,80,000/- and has received the remaining amount of Rs.40,000/- and states that she has no objection is the impugned judgment dated 06.04.2024 is set aside. 5.
Accordingly, the judgment dated 06.04.2024 (hereafter 'impugned judgment'), passed by the learned Additional Sessions Judge ('ASJ'), Dwarka Courts, Delhi, in CA No. 84/2024 is set aside. 6.
In view of the above, the present petition stands disposed of. 7.
