% 05.07.2017 1.

In this appeal it was found that the original record stood destroyed.

By the order dated 21.4.2017, it was ordered that the parties will sit together and prepare a common compilation of the arbitration record. Today however it is stated that record cannot be compiled. Therefore in the absence of the record, the appeal cannot be argued as stated by the counsel for the appellant.

2.

Accordingly, this appeal is dismissed because the same cannot be decided in the absence of the original record, however, in case parties are able to reconstruct the record and file a common compilation in this Court, then, any of parties thereafter can seek revival of this appeal.
